User Service Agreement

1. Scope of Services

1.1 The Operator provides users with free overseas novel reading services through the ZestNovel platform, including but not limited to providing access to the overseas novel library, personalized recommendation services, reading record synchronization functions, as well as auxiliary functions such as bookshelf management and offline reading. The Operator may adjust the specific content of the services from time to time according to operational needs, and will notify users of major adjustments through prominent announcements within the APP or other reasonable means.

1.2 In case of force majeure, legal requirements, or necessary technical upgrades of the ZestNovel system, the Operator has the right to add, suspend, or terminate part or all of the services without prior notice. Except as otherwise provided by law, the Operator shall not be liable for any losses suffered by users as a result.

2. User Obligations

2.1 When registering an account, the User shall provide true, accurate, and complete personal information (such as email address, username, etc.) and update such information in a timely manner to maintain its validity. If the User provides false or incomplete information, the Operator has the right to refuse to provide services to the User or terminate the User's account.

2.2 The User shall properly keep the account credentials (such as account name and password) and assume full responsibility for all activities conducted through this account. If the User discovers any unauthorized use of the account or other security risks, the User shall immediately notify the Operator and take necessary measures to prevent the expansion of losses. The Operator shall not be liable for any losses caused by the User's failure to properly keep the account credentials.

2.3 When using ZestNovel and its services, the User shall not engage in any illegal or improper activities, including but not limited to:

• Infringing upon the intellectual property rights, privacy rights, reputation rights, or other legitimate rights and interests of the Operator or third parties;
• Uploading, publishing, or disseminating content containing illegal or harmful information, such as violence, pornography, terrorism, hatred, slander, or discrimination;
• Using the application to engage in illegal or criminal activities such as fraud, gambling, or money laundering;
• Conducting reverse engineering, decompiling, cracking, or attempting to interfere with the normal operation of ZestNovel;
• Other acts in violation of laws and regulations or the terms of this Agreement.

3. Intellectual Property Rights

3.1 All intellectual property rights of the software copyright, trademarks, interface design, and operation rules of this application belong to the Operator and are protected by the Copyright Law of the People's Republic of China, the Trademark Law, and other relevant laws and regulations.

3.2 The copyrights of all overseas novel content within this application (including text, plot, character settings, etc.) belong to the Operator or the legitimate right holders. The User only enjoys the right to read for personal non-commercial use. Any form of copying, distribution, adaptation, commercial use, or other use of the content of this application is prohibited. Violators shall bear corresponding legal responsibilities.

3.3 Without the prior written permission of the Operator, the User shall not use any intellectual-property-related content of the application, such as its name, logo, and trademarks.

4. Privacy Protection

4.1 The Operator attaches great importance to user privacy protection and will collect, use, store, and disclose users' personal information in accordance with the Operator's privacy policy.

4.2 The User acknowledges and agrees that the Operator may collect necessary user information to provide and optimize the services of ZestNovel, such as reading preferences, device information, and usage data. Except as required by law or to protect the legitimate rights and interests of the Operator or other parties, the Operator will not disclose the User's personal information to third parties without the User's consent. For non-necessary personal information, the User has the right to refuse to provide it, and the Operator shall not refuse to provide the basic reading service to the User on this ground.

5. Disclaimer

5.1 ZestNovel and its services are provided "as is" and "as available." The Operator makes no warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Operator does not guarantee that ZestNovel can operate without interruption or error, nor does it guarantee that all defects can be corrected. The Operator shall not be liable for any losses or damages caused by network delays, interruptions, or other force majeure factors resulting in the temporary unavailability of the service.

5.2 The Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use ZestNovel, including but not limited to loss of profits, data loss, or other intangible losses, even if the Operator has been informed of the possibility of such damages.

6. Termination

6.1 This Agreement shall come into effect as of the date of acceptance by the User and shall remain in force until terminated in accordance with the provisions of this Agreement.

6.2 The User may terminate this Agreement at any time by uninstalling ZestNovel and ceasing to use all services.

6.3 If the User violates any term of this Agreement, the Operator has the right to terminate this Agreement and close the User's account without prior notice. After termination, the User's right to use ZestNovel and its services shall terminate immediately, and the Operator shall not be liable for any losses caused thereby. After termination, the User shall stop using all content and services related to ZestNovel.

7. Governing Law and Dispute Resolution

7.1 The conclusion, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding the laws of Hong Kong, Macao, and Taiwan regions).

7.2 Any disputes arising from this Agreement shall first be resolved through friendly consultations between the two parties. If the consultations fail, either party has the right to file a lawsuit with the people's court having jurisdiction over the place of registration of the Operator's company.
